Statement of Kabataan Partylist on HB 6330

Kabataan Partylist is withdrawing House Bill 6330, or An Act Empowering Heads of Offices and Departments to Strictly Implement the Constitutional Provisions on Religious Freedom in Government Offices, in response to the appeal and clamor of some of our members, constituents and supporters, various groups, institutions and the general public to reconsider the filing of such measure.

 

Kabataan Partylist seeks to clarify that the bill has no intention to “ban God”, suppress any religion or belief and prevent government employees from practicing their faith. The purpose of the bill is to ensure that government offices do not favor one religion over the other,  or discriminate one against the other.

 

Kabataan Partylist sincerely apologizes for any offense the bill caused. We are sad that we hurt the religious sentiments of many, when our desire was to uphold and promote religious sensitivity and harmony.

 

We hope the conversations will continue about the need to respect different beliefs in society. We are encouraged by the fact that despite the misunderstandings, the bill initiated relevant discussions on freedom of religion as one of the fundamental rights enshrined in the Constitution.

 

Kabataan Partylist would rather continue prioritizing other pending bills and advocacies that it had been promoting for the past three years and which need utmost attention at present. Among these are the need for education reforms, protection of workers’ rights, environment protection, good governance and consumer rights empowerment. In particular, the passage of measures such as the Tuition Regulation Bill, review of the K+12 program, Students’ Rights Act, Anti-No Permit, No Exam Act, BPO Workers’ Welfare Act and Public Wi-Fi Bill.

    What happened?!?  You filed one of the most sensible and bold legislative bills.  It is sensible because it an open-and-shut legal issue.  Our Constitution provides for the separation of Church and State.  In practice, it means not favoring any religion.  But all we are seeing in government buildings are Catholic crosses and what they are doing are Catholic masses.  It is bold because the idea that the Catholic Church is dominating our national life must be challenged.  But by backtracking, you inadvertently showed that the Catholic Church is still overwhelmingly dominant indeed.

    I know that you are a politician and you therefore need to count the numbers.  But don’t over-count the Catholic votes and don’t under-count the people who have rejected this domineering attitude of the Church from issues like RH, to impeachment and many others.  If there is one thing we expect from the Youth, it is boldness and fresh ideas.  Don’t recycle the stale thinking of the past.

    There is still hope that you can steal victory from the jaws of defeat.  Why don’t you file a case in the Supreme Court asking if it is constitutional for government offices to spend employees time (therefore, people’s money) for masses?  Ask the SC if government offices can openly show religious images.  This approach will shield you from too much flak as you are letting the Supreme Court take the decision — and the heat.  You will likely win here as the jurisprudence in this case is very, very clear already.

       Separation of the Church and the State simply means that the State will not imposed upon its citizens a “state religion” OR trample upon their right to free expression of their religious beliefs; and in the same token, read this:

        Separation of Church and States also means that the latter shouldn’t be in the business of favoring any one religion in its legislation.

           To put it another way: I don’t have any problems with people in government having a religion – that is their right. However, them using government resources (such as holding mass in the SC quadrangle), or passing religiously-motivated legislation (Manila’s contraceptive ban) are clearly crossing the line.

            Those government resources are paid through taxes by people who are employed at government offices. SO they have the right to make use of those facilities. It’s for all taxpayers, actually. (And sometimes, even non-taxpayers). It’s just that most Filipinos are Catholics that they appear mostly visible and active in expression of their religious beliefs, regardless if in public or private-owned areas.

    In fact, a secular society should be genuinely secular; France, Turkey are secular countries despite we often see these as Christian and Muslim, it’s just that people in the Philippines are too fatalistic so to speak.

    I am a christian, but come to think that how come there should be religious intervention in state affairs? We don’t need EDSA as it’s proof, remember the way Mabini opposed Paterno that resorted to having a clause declaring an inevitable separation of church and state. This society needs to think that freedom of religion and personal belief is different from having an official religion; to think that in every place should have a chapel, in UE for instance, there are Muslims, yet they have no prayer room for them while their christian friends had a chapel; if they want to insist their pipe dreams why not they themselves file for a law having paid sabbaticals for holy week and Christmas vacation? See!

    Anyways, this is frailocracy. Our law is the canon law, that everyone calls it “morality”. What’s the use of our independence then? What’s next condemn the flag for being influenced by freemasonry? Will they interpret the three stars as the holy trinity? God forbid, but the ones opposing are blasphemous than what Palatino did, they are the ones performing personality cults all the time anyway!

    Congressman Mong, I really urge you not to drop this issue like a hot potato.  You already raised this issue and generated our support and expectations.  You cannot just leave us in the lurch just because you were spanked by your parish priest.

    Even if you have already announced that you are withdrawing the bill, please state that you are continuing the discussion and that you may re-file the Bill at appropriate time — which is soon.

    I am looking at your legislative agenda — review of K-12, questioning the no-permit, no exam, and the public wifi bill.  They are fine but pale in comparison to your landmark bill of strengthening the separation of Church and State.  Will you be the run-of-the-mill congressman who will give me wifi in the mall or will you be that bold, young lawmaker who battled the giants in the Church and the cynicism of your colleagues in Congress but was able to pass a landmark legislation on the sheer weight of its logic and timeliness. This bill would have been a case study in all law schools and polsci classes in the country for years to come, but your wifi bill will hardly merit a mention.

      This will not strengthen the separation of Church and State. Rather HB6330 will impose upon the people and infringe on their right to free expression of their religious beliefs.

       NY_Pinoy, it is up to us to generate enough public support so that HB 6330 can be revived (or reincarnated in another bill). I agree that this is one heck of a good bill. But you also can’t deny the impact of the Catholic Taliban in the country. They can make life hell. And these sanctimonious S.O.Bs have reportedly harassed Rep. Palatino online by sending threats thru his Facebook account. So, we really have to match these Catholic Talibans’ outrage with our support.

      adopt appropriate working schedules to ensure that all clients who are
      within their premises prior to the end of official working hours are
      attended to and served even during lunch break and after regular working
      hours.”So, there’s already an exisitng law that adresses improvement in efficiency in the delivery of government service to the public… – therefore, this bill is redundant and will only waste the country’s limited funds – that besides the fact that HB6330 is unconstitutional.

    this is so sad… we, individuals and group members of the United Pagans Philippines are strongly supporting the proposed bill. We have long kept our quiet from the biases of the mainstream religion, and found this bill a helpful one in our desire to gain religious freedom. 

    we do not see any pentacles, Celtic crosses, and other pagan symbols in government offices – this goes to show that there are biases even in the government…

    our belief system has not been recognized by the state, and kept our rites in secret due to our fear of being persecuted and discriminated against. 

    if we give in to the heed of the majority, who will listen to the voice of the minority? if the mainstream religion wishes to conduct their ceremonies, they can do it in their churches… if they want to display religious icons, they can do it on their own houses and institutions… the government is by the people and for the people… not just for certain religious groups… :(

        is williams a Filipino? does he know the state of our country and how the RCC leaders meddle with the government’s work? public acknowledgment is not the same as spending the government’s money (which is the people’s money) to celebrate or to hold one particular religion’s ceremony or to buy religious icons venerated upon by one religion alone. 

        the religious symbols exist for the good of the society? has he experienced being evangelized by a government employee upon seeing a pentacle on a pagan’s neck? has he experienced being laughed at and told to be a devil worshipper when putting on “wicca” or “pagan” on a document filed? has he talked to government employees who had to hide their beliefs in fear of being discriminated against, simply because they’re wiccans/pagans? these religious symbols show supremacy above the rest of the minor religious groups.why the catholic church? if you go to government offices, what religious icons do you see? aren’t they that of the RCC? – just shows again how one particular religion is being adhered upon by the government… and this is biased.I am supporting the bill not because i am a non christian.     Might be more prudent for Kabataan Partylist to pass several bills that will gradually improve the state of education in the Philippines.

    It will take longer, but it does provide for a solid foundation so that when they try to pass House Bill 6330 again, it will be to a more secular – and therefore more receptive – society that’s learning to favor critical thinking and scientific inquiry over religious nonsense.

      You have no right to utter things such as “religious nonsense.” The only reason why there are still good human beings left in this world is because they do not let go of the teachings that the Roman Catholic and other Christian religions has inculcated in their minds.Moral standards are always formed through Christian religion….regardless of the imperfections of its members. And besides, scientific inquiry must not be relied upon at all times. Science admits that it cannot answer everything…so it is NOT THE ULTIMATE BASIS FOR EVERY QUESTIONS OF HUMAN LIFE.

    Your bill is just a waste of time. Concentrate on prevalent issues that we need to address immediately. KABATAAN PARTYLIST should function for the welfare of the young people, but you are concocting a bill which should not be your line of responsibility. Wake up!!!     1. Young People’s easy access to education – NO LEFT BEHIND
    2. Provide more funds for BARRIO SCHOOLS
    3. Formalization of Kariton School as means of educating young people.
    4. Restructuring of SK.
    5. Young People’s access to Psychological Health Services
    6. Laws that will foster YP’s morality.

    YOU CAN THINK OF MORE BILLS! Please.

    The Catholic Church is a mother who values the total well-being of her children, physical and spiritual. Hence she teaches the truth so that her children will be truly free. She is Mater et Magistra – Mother and Teacher. But children do not always listen to parents, do they? Accept it or not, humans are entities with bodies and spirits, and both have to be  nurtured. Physically, some of the major reasons the Church is anti-contraceptives is because 1) estrogens are powerful hormones that have wide-ranging effects on the body (women and gays are now taking them) often causing cancers, so much so that they have been put on the Carcinogen List by the FDA; breast cancer statistics have risen together with hormonal contraceptive usage; 2) hormonal contraceptives can act as abortifacients or teratogens, killing or maiming the unborn; 3) sewage run-offs of synthetic estrogens used in commercial Pills have caused feminization of fish species in many parts of Europe and the United States; e.g. UK has estimated billions of pounds needed to retrofit the sewage systems in England to take care of the mess that the Pills have caused, and legislation to have pharmaceutical companies that profit from Pill sales foot the bill has been strongly protested and being lobbied against by these same companies; imagine fish that can no longer breed – shortage of fish! 4) just as fish are no longer breeding, humans are no longer breeding, leading to demographic winters – meaning, the population is ageing without replacements, causing economic upheavals in Europe, Japan, Singapore, HongKong, and eventually the United States because of the lack of workers and buyers, plus pensions for elderly are not being replenished by new generation of workers….

    I’ll reserve the spiritual aspects for next time.

Cong..but i really want this bill to be pass in the congress but as far as i can see Pilipino people are not yet open in the issues like this, think it’s because majority of the Pilipino is Catholic and sub-catholic denomination who practice idols. So for now its good to put this thing in the least priority of Kabataan Partylist may be Cong. you can focus on the bill that will help our education system and how poor youth can go to colleges. Its a bold and timely issue and it shows that the government does not favor a particular religion over another and that the minority need not feel marginalized by the majority even if its unintentional. Finally I thought someone has taken the challenge of Rizal and imbued with his Spirit took a stand and finally I thought the youth really was the hope of the nation. But alas, it seems that the powers that took down Jose Rizal still remain in power. In his exposition of the truth Jose Rizal hurt a lot of feelings but he never backed down and  history will always remember him.

    Na amaze  ako sa mga comment ng mga matatalino sa batas….grabe. Tama, male, panget, maganda, katoliko, protestante etc. naisip nyo na ba na pag namatay kayo iisa lang ang pupuntahan ng kaluluwa nyo? Pag mabuti sa langit, pag masama sa impierno. 

    Lahat ng pinagtatalunan natin ay pansamantala lang po, ang pang habang buhay naiisip na ba natin, lahat tayo alam ang buhay na walang hanggang,,, handa na ba kau humarap sa Diyos na ang tanging pinapatupad lamang na batas ay magkaroon ng tamang RELASYON sa kanya…dahil wala kahit anong klaseng relihiyon ang kaya kayong iligtas sa kapahamakan ng impierno. Hindi itatanong ng Diyos sayo pag harap mo sa kanya kung ilang batas ang naipasa mo? o kaya katoliko ka ba? o kaya Iglesia ka ba ni manalo…isa lang po ang tanong ng Panginoon….ikaw o ako sumunod ba tayo sa kalooban ng Diyos noong tayo ay nabubuhay pa? Tama ba relasyon natin sa kanya? kilala mo ang Diyos? tanong… ikaw ba kilala ng Diyos? Oo naman papano ka nakakasiguro kung di mo alam ang salita nya ANG BIBLIA?

    Mabuti nmn kung ganun…there are a lot more concerns that we need to face, discuss and solve…though i am thankful that this issue was opened-up and brought to the public which made us hear and know more sentiments from the different sector-concerned in our society. This a bold move and you must not just stop and never to follow up this issue… but i guess this must undergo a slow but healthy process. After all, this concerns not just the religious perspective of all Filipinos but our culture as well.
